1. Acceptance of Terms

By accessing or using any Nova Engine Studio ("Nova Engine," "we," "us," or "our") website, game, or service (collectively, the "Services"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Services.

2. Eligibility

You must be at least 13 years of age (or the age of digital consent in your jurisdiction, whichever is higher) to use our Services. If you are under 18, you must have a parent or guardian's consent. By using the Services, you represent and warrant that you meet these requirements.

5. Intellectual Property

All content, software, graphics, characters, music, sound effects, storylines, trademarks, and other intellectual property in our Services ("Nova Engine IP") are owned by or licensed to Nova Engine Studio and protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial entertainment purposes. You may not reproduce, distribute, modify, or create derivative works of Nova Engine IP without our prior written consent.

6. User-Generated Content

You retain ownership of content you create and share through our Services ("User Content"). By submitting User Content, you grant Nova Engine a worldwide, royalty-free, sublicensable license to use, reproduce, modify, and display it in connection with the Services.

You represent that you own or have the necessary rights to your User Content and that it does not infringe third-party rights or violate these Terms.

7. Virtual Items and Purchases

Our games may offer virtual currency, items, or other digital goods ("Virtual Items") for purchase. Virtual Items:

  • Have no real-world monetary value
  • Are non-refundable except as required by law
  • Are licensed, not sold, and may be modified or removed
  • Cannot be transferred outside the game
  • May expire if your account is terminated or the game is discontinued

8. Third-Party Links and Services

Our Services may contain links to third-party websites or integrate with third-party services (e.g., social media login, payment processors). We are not responsible for the content, privacy practices, or terms of these third parties. Your interactions with third parties are solely between you and them.

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, error-free, or secure, or that defects will be corrected.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOVA ENGINE STUDIO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY.

Our total liability for any claim shall not exceed the amount you paid to us in the twelve months preceding the claim, or one hundred dollars (USD $100) if no payment was made.

11. Indemnification

You agree to indemnify and hold harmless Nova Engine Studio, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your breach of these Terms, your User Content, or your use of the Services.

12. Termination

We may suspend or terminate your access to the Services at any time, with or without cause, without prior notice. Upon termination, your right to use the Services ceases immediately. Provisions that by their nature should survive termination (including intellectual property, disclaimers, and limitations of liability) shall survive.

13. Governing Law

These Terms shall be governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the courts located in Los Angeles County, California.

14. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via our website or email. Your continued use after changes are posted constitutes acceptance of the revised Terms.
